Letters before action  

KJD's standard first solicitors letter before action is sent free of charge irrespective of the size of the debt.  We will write to you informing you when the debtor has made payment, or if further action is needed. See send a letter demanding payment

 

If interest is to be claimed under your terms of trading or if interest and a fixed sum are to be claimed under the Late Payment of Commercial Debts (Interest) Act 1998 and Regulations, an additional charge of £10 will be charged for calculations of interest on a number of invoices exceeding 20.  There is an additional charge of £10 for each further group of up to 20 invoices.

Issue of County Court Proceedings and obtaining judgment

 

We charge a fixed fee for the issue of County Court proceedings and entry of judgment.  The fixed fee is based on a sliding scale and is calculated in accordance with the fixed sum awarded by the court. The fixed fee would be between £70 and £120 depending on the size of the debt. There is also an additional feeof between £22 and £55 to cover judgement. This is also dependant on the size of your debt and is reflective of the fixed costs awarded by the court. For example to issue a County Court summons to recover a debt of £900 we will charge £90 plus the applicable Court fee.  The Court will allow you to recover from the debtor up to £70 plus the applicable Court fee.

Enforcement may also be attempted by way of a charging order, Attachment of earning, Third Part Debt order or by obtaining an order for the debtor to attend court for questioning. Our charge for these methods are calculated on an hourly rate dependant on the complexity and time spent on your behalf.

 

Insolvency proceedings

 

We charge £85 to prepare a statutory demand against an individual, partnership or company plus our agents fees for service of the demand.

 

If we issue a bankruptcy or winding up petition and the debt is recovered we also usually recover the majority of the costs from the debtor.  However we do not necessarily receive all of our costs from the debtor.  We limit our charges to you to a maximum of £295 over and above what we recover from the debtor.  Where costs are ordered to be paid by the debtor but are not paid or where a separate agreement is reached between you and the debtor we reserve the right to charge all of our costs to you.  It is our policy to discuss any such charges with you before invoicing.

 

Disputed statutory demands and petition proceedings are charged on an hourly rate basis by separate agreement.

 

Miscellaneous

 

We may charge additional sums in circumstances where:

  • there is more than one debtor;

  • the debtor is outside England and Wales;

  • proceedings are served personally;

  • a method of enforcement is defended or protracted;

  • proceedings require amendment and reserving;

  • notice of discontinuance is prepared and served;

  • preparation and service of a consent order is required;

  • other non-standard work becomes necessary.

Court fees, disbursements and VAT (where applicable) are chargeable in addition to the figures quoted above.  Where possible these are recovered from the debtor.

 

If proceedings become disputed we charge our time for work done on an hourly rate basis by separate agreement with you.  We will always inform you and obtain your agreement before proceedings and provide our terms for dealing with disputed debts.
